Privacy Policy
This Privacy Policy explains how TurnerTrack LLC (“Company,” “we,” “us,” or “our”) collects, uses, and protects information when you use the turnertrack software and related services (the “Service”). Because the Service includes location-based time tracking and handles business and financial data, please read the sections on location and financial data carefully. By using the Service, you agree to the practices described here.
1. Information We Collect
- Account information: your name, email address, password, and business or organization details.
- Location data: precise geolocation (GPS) collected from a worker’s device to provide location-based clock-in and geofencing and to display the live Crew Map. See the Location Data section below.
- Business and financial data: information you enter to operate the Service, such as job costs, payroll figures, hours worked, and bank or cash amounts.
- Usage and technical data: information automatically collected when you use the Service, such as IP address, device and app version, log and diagnostic data, and essential cookies needed to operate the Service and keep you signed in.
2. How We Use Information
We use the information we collect to:
- provide and operate the Service, including location-based clock-in, geofencing, the Crew Map, job costing, and payroll tracking;
- maintain, secure, troubleshoot, and improve the Service;
- process payments and communicate with you about your account; and
- comply with legal obligations and enforce our Terms.
3. Location Data
The Service collects precise location data from a worker’s device to deliver its core features: confirming that clock-in and clock-out occur within designated job-site geofences, and showing worker locations on the live Crew Map. Location is collected only while a worker is clocked in and only as needed to provide these features. It is not collected when the worker is off the clock, and it is not used for any unrelated purpose.
Responsibilities of business customers (employers). If you use the Service to track your workers, you act as the controller of your workers’ personal data and are solely responsible for notifying those workers about location collection, obtaining any consents required by law, and complying with applicable employee-monitoring, labor, and privacy laws. Many states regulate location tracking. For example, Virginia law (Va. Code § 18.2-60.5) generally requires a person’s consent before an electronic device is used to track their location and prohibits doing so through deceptive means; several other states have similar consent-based requirements. Accordingly, before enabling location features for any worker, you should obtain clear, written consent or acknowledgment from that worker, limit tracking to working hours, and avoid tracking during personal or off-duty time. We process worker location data on your behalf, in accordance with your instructions and this Policy. Workers with questions about how their employer uses location tracking should contact their employer.
4. Business and Financial Data
Job-costing, payroll, and bank or cash figures that you enter are stored on our systems solely to provide the Service. We treat this information as confidential and protect it using the safeguards described below. We do not use it for advertising and we do not sell it.
5. How We Share Information
We do not sell your personal information, and we do not share it with third parties for their own marketing. Your data is processed on our own systems, and we share information only:
- with our payment processor, Stripe, to process subscription billing (we do not store full payment card numbers);
- with infrastructure and service providers that help us host and operate the Service, under confidentiality obligations and only as needed to support the Service;
- as required by law or to protect the rights, property, or safety of the Company, our customers, or others; and
- in connection with a business transfer, such as a merger or sale of assets.
6. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, particularly location and financial data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Data Retention
We retain information for as long as your account is active or as needed to provide the Service, and thereafter as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. Location records are retained only as long as needed for the time-tracking and reporting purposes they serve, or as you direct.
8. Your Rights and Choices
Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal information — for example, under the Virginia Consumer Data Protection Act and similar state laws. Where we process worker data on behalf of a business customer, that customer controls the data, and individuals should direct requests to their employer, who will coordinate with us as needed.
9. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new effective date and, where required, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
